Welcome to “Make it Easy” (“App”), an iOS and Android application developed by We Make it Easy Pty Ltd (“Developer”, “we”, “us”, or “our”). By using the App, you agree to be bound by these Terms of Use (“Terms”). If you do not agree with these Terms, please do not use the App.

1. Description of the App

1.1 Overview

“Make it Easy” is a mobile application that uses artificial intelligence to simplify and summarise text content. The App is provided on a limited free basis, and once downloaded, you will have access to its basic features.

1.2 Premium Options and Free Trial Period

Access to some services and/or additional features within the App (“Light” and “Pro” options) requires paid subscriptions. You will have an opportunity to try these options during the free trial period as provided on the signup screen. After the free trial period expires, an auto-renewing subscription period will start on a regular basis. Premium options are available during the whole free trial period.

1.3 Limitations and Disclaimers

The quality of the simplified text depends on the source material and may not always meet user expectations. The Developer is not responsible for the content of the simplified and abridged text. The App does not provide professional advice of any kind (e.g., health, legal, financial). Content produced by the App is for informational purposes only and may omit critical details. Users should not rely solely on the App’s outputs for decision-making and should seek professional advice when necessary.

1.4 The Text to Speech (TTS) voice/s you hear in the App are ai generated and are not human voices.

2. No Liability

2.1 Assumption of Risk

You acknowledge and agree that your use of the App is at your own risk.

2.2 Limitation of Liability

The Developer shall not be liable for any damages or losses resulting from your use of the App, including, but not limited to, any inaccuracies or omissions in the simplified text, loss of data or information, or any other consequence arising from your use of the App. Additionally, the Developer is not responsible for any downtime, crashes, or failures of the App, including issues related to the underlying AI processor or technical infrastructure.

2.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer rights you may have under the Australian Consumer Law (ACL) or any other applicable laws. You are entitled to certain guarantees regarding the provision of services, including that they are fit for purpose and provided with due care and skill.

3. Data Storage and Management

3.1 Storage

EasySnaps are stored on our secure servers in Australia for 30 days. After 30 days EasySnaps are permanently deleted.

3.2 Data Loss

If you reinstall the application or delete your data, your information and EasySnaps history may be lost.

3.3 Privacy Policy

The use of the App is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal data. The Privacy Policy is available within the App and on our website. By using the App, you consent to the practices described in the Privacy Policy.

3.4 Data Security

We implement reasonable measures to secure your personal data. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. If third-party services are used to process or store your data, their terms and practices also apply. We do not allow your EasySnaps to be used for ai training purposes.

4. Research and Evaluation Use

4.1 Permission to Share Deidentified Data

You agree that we may share your deidentified data with a third party for research or evaluation purposes. Deidentified data means information that cannot reasonably identify you as an individual. This includes removing names, email addresses, phone numbers, account details, and any other personal information as defined under Australian privacy laws.

4.2 Purpose of Sharing Data

We may share deidentified data to help researchers, universities, or evaluators study how people use the App, how well the features work, and how we can improve accessibility and inclusion.

4.3 How We Protect Your Privacy

Before we share any data, we will take reasonable steps to make sure it is deidentified. Once data is deidentified, the information is no longer considered personal information under the Privacy Act 1988 (Cth).

4.4 No Sale of Personal Data

We will never sell your personal information. We will only share deidentified data for the purposes described in this section.

4.5 Right to Withdraw Consent

You can withdraw your permission at any time by emailing help@makeiteasy.com.au. If you withdraw your permission, we will not share any future data linked to your use of the App. This does not affect any deidentified data that was already shared before you withdrew your permission.

5. Subscriptions, In-App Purchases, and Renewals

5.1 Subscription Information and Pricing

When using the App, you can choose different subscription options. Subscription prices are in Australian dollars, may vary in countries other than Australia, and are subject to change without notice. You will have all necessary information about your subscription plan and the duration of the free trial period on the signup screen before the purchase.

5.2 Auto-Renewal and Cancellation

Your subscription will be automatically renewed within 24 hours before the current subscription ends. The auto-renew option can be turned off in your iTunes or Google Play Account Settings at least 24 hours before the end of the current period. Payment will be charged to your account at confirmation of purchase. No cancellation of the current subscription is allowed during the active subscription period.

5.3 Refund Policy

Refunds for subscriptions and in-app purchases will be provided in accordance with Australian Consumer Law, which may entitle you to a refund for services that are not fit for purpose, provided with due care, or do not match their description.

5.4 Unused Free Trial Periods

Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription, where applicable.

5.5 In-App Purchases

Certain services within the App may be available as an In-App Purchase.

5.6 Changes to Subscription Plans

We reserve the right to modify, terminate, or otherwise amend our offered subscription plans at any time.

5.7 NDIS Claim Eligibility

The App’s cost may not be claimable under all NDIS plans. Participants and nominees should verify with the NDIS or their plan manager before making a purchase.

6. Intellectual Property

6.1 Ownership

All intellectual property rights, including trademarks and logos, generated by the App are owned by the Developer.

6.2 User Content

Users retain ownership of the text they upload to the App. The Developer does not claim ownership of the translated or summarised texts. By using the App, you grant us a non-exclusive, royalty-free license to use your uploaded content solely to operate and improve the App’s functionality, including training AI models.

7. Prohibited Uses

You agree not to use the App for:

  • Any illegal activities or purposes.
  • Attempting to hack, damage, or disrupt the App’s functionality.
  • Uploading content that is defamatory, obscene, or infringes on the rights of others.
  • Users are responsible for ensuring they have the right to translate and store content.
  • Make It Easy does not endorse or facilitate copyright infringement.
  • Make it Easy app is for personal use only.

8. Governing Law and Dispute Resolution

8.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Australia.

8.2 Dispute Resolution

In the event of a dispute, you agree to first attempt to resolve the issue through informal negotiation by contacting us at help@makeiteasy.com.au. If the dispute cannot be resolved informally, it may be submitted to arbitration or mediation before proceeding to formal legal action.

8.3 NDIS Complaints
If you are an NDIS participant or nominee, you can complain to the NDIS Commission at https://www.ndiscommission.gov.au/complaints or call 1800 035 544 (free call from landlines) or TTY 133 677. Interpreters can be arranged or you can use the National Relay Service: ask for 1800 035 544

9. Termination of Use

We reserve the right to suspend or terminate your access to the App at our sole discretion if you violate these Terms or engage in prohibited activities.

10. Modifications to the Terms of Use

10.1 Amendments

We reserve the right, at our sole discretion, to modify, amend, or update these Terms at any time.

These terms were last updated on 11/05/2025.

10.2 Accessibility of Updates

Any changes will be effective immediately upon posting the revised Terms on our website or in the App. We may notify users of significant changes via a popup or notification within the App.

11. Accessibility Features

The App includes accessibility features such as text-to-speech and Easy English support to ensure it is usable by a diverse range of users.

12. Force Majeure

The Developer shall not be held responsible for any failure or delay in performance caused by factors beyond our reasonable control, including natural disasters, cyberattacks, or service interruptions.

  • We cannot restore deleted data.

  • We follow privacy rules and try to protect your information.
  • However, no system is 100% secure.
  • We are not responsible if someone else accesses your data.
